The New York State Unemployment Insurance offers additional programs to long-term unemployed workers who exhaust their state UI benefits. In total the NYS UI program provides a maximum of 93 weeks of unemployment benefits to insured workers who have lost their employment due to no fault of their own. These 93 weeks are divided between three programs: the state Unemployment Insurance program, the Emergency Unemployment Compensation program and the Extended Benefits program.
The State UI offers a maximum of 26 weeks. If after 26 weeks you are still fit and willing to work and still meet the program’s requirements you can apply for the Emergency Unemployment Compensation, or EUC, program.
The EUC program is a federally funded program that focuses on long-term unemployed workers who exhaust their basic state UI, especially those who live in states with high unemployment rates. The program is divided into four tiers. Tiers 1 and 2 are available to all states, while tiers 3 and 4 are only available to workers in states with unemployment rates of 6 percent and 8 percent, respectively. Tier 1 provides 20 weeks, Tier 2 grants 14 weeks and Tier 3 allows for 13 weeks. The fourth tier gives workers an extra 6 weeks. NYS qualifies for EUC tiers 1,2 and 3, which provides a total of 47 weeks. This program will stop accepting new applications in January 2012. Each tier has a different cut-off date for workers who are already registered. Workers on tier 1 will receive their full 20 weeks as long as they register before 01/01/2012. Workers in tier 2 will receive their 14 weeks just as long as they exhaust their tier 1 weeks by 01/01/2012. Tier 3 payments for qualified insured workers will continue up to 06/10/2012.
It is important to know what the cut-off dates for each tier and program are because if you make partial claims or take a break in your claim (e.g. you forget to file a weekly claim) your exhaust date might fall after 01/01/2012 and you may be disqualified from further tiers or programs.
New York State has an unemployment of 8.2 percent. This is below the trigger rate of 8.5 percent required to access tier 4 payments. If you exhaust your EUC benefits and still can’t find work you may qualify for NYS Extended Benefits.
The NYS Extended Benefits provides workers with up to 20 weeks of unemployment compensation benefits. To qualify you must apply before 1/08/2012 and have files your initial state UI claim by 8/02/2010. Notice, however, that the week of 1/08/2012 is also the last week the program will pay out benefits.

The NYS Unemployment Insurance Program provides temporary income to insured workers who meet the program’s requirements. It is easy to disqualify yourself from unemployment benefits if you don’t understand the employment law of NYS. Also, the Unemployment Insurance law can change from one state to another, which can cause misunderstandings. What Employment Requirements Do I Need To Meet?
To qualify for unemployment benefits in NYS you must have lost your job due to lack of work or some other reason where you were not at fault. You must also have worked for a registered employer in at least two quarters of your last base period. A base period is the period you are assessed for to judge your eligibility for UI benefits and includes the first four quarters of the last five quarters. A year is divided in four quarters starting from January to March and ending with October to December. For instance, if your were laid off in February 2011, your base period would span from September 2010 to October 2009.
You must have also earned a minimum of $1,600 during one of your base period’s quarters and your total base period earnings must be at least one and a half times your highest earning quarter. To illustrate, if you earned $3,000 in your highest earning quarter, you must have earned at least $4,500 during the rest of your period.
An alternative way of assessing your benefits is to use your alternate base period which spans the last four quarters of your base period. To illustrate, if you lost your job in February 2011, your alternate base period would go from December 2010 to January 2009. In case you do not qualify for benefits using your base period or you think you would get a larger weekly benefit amount with this method you should request the Department of Labor to use this method to estimate your weekly benefit amount and total entitlement.
If you do not qualify for benefits with either your base period or alternative base period but you think you would qualify if your latest work were included, you can wait until the next quarter to make your initial claim.

The New York State Department of Labor is responsible of managing the New York Unemployment State Services programs.
